You should have had the owner get a payoff statement, show it to you directly and sent the money directly to the bank holding the note.

yeah OK that would be great. However, we knowingly bought the boat wo the title, trusting he would go pay it off. However, that doesn't seem to be the case. We are pressing forward with certified letters and my attorney. He's had 24 days to go pay the note off. Granted, thanksgiving, etc, all was in the way, but it should of been plenty of time to pay the note off.

Man….. you can't get a break… what made you think it was OK to give him money and not receive the title? rookie mistake brother… If it needed payed off you should of followed him to the bank… 30 Grand is a lot to trust someone you don't know with….

Yeah I know. I realized the risk way before we got to see the boat. This is sometimes what you need to do. We couldn't follow him to the bank that day, the timing wasn't working for us. So the seller says he forgot, and he's going to take care of it today. We shall see.

You'll have to wait another 2-3 weeks before you get the title from the bank/guy once its payed off. Have him send you the recipt of the pay off from the bank once he completes the transaction so that you can sleep at night.

That sucks mancho, sounds to me like the guy has a spending problem if the loan is in his wife's name. And the fact that he got the money and his first priority wasn't going to the bank :( I hope and pray for you that he has the payoff $$$$ left!!!! Sorry to hear about your misfortune mancho

Did you get a bill of sell with his and her names on it? Photo copies of their driver licenses?

 

At least the boat's in South Carolina the bank will never find it there.

I hope as posted by Rhunt that you have a few key pieces of information to use when the Cops show up to take your boat. ( Lets hope this is not the case) Cause then you could be on the hook for receiving stolen property then all of the sudden that smoking deal that you got on the boat of your dreams becomes HOT! Literally.

Wow, I just read this update. Not good Mancho. Any word yet?

 

On my last used boat transaction the buyer sent the money directly to the bank (and paid off the note) and then the bank turned around and cut a check back to the seller for the difference. That way the third party (the bank) was the buffer.

Because we paid part cash, part paypal, part cashiers check, it wasn't possible that day to go directly to the bank. I have faith in the guy, I'm not bad mouthing him. He's a decent guy... hey, he bought a centurion! lol I can be frustrated of course. I agree the money should of been made out to the bank so the note would of been relieved first. Fingers crossed that this works out. Nothing new as of yet. I'll probably call his bank tomorrow to check and see if the note was satisfied.

Did you say you have the bill of sale? The bank should still have his title if there was a lien on it so I would contact the bank directly and show them the bill of sale. They may be able to do some work on their end. Hope this all works out for you! Keep us posted!

All I can say is WOW!!! I cannot believe you did not do everything through the bank. If you do not have a bill of sale you have no way of proving you gave him money, the only thing you can prove is that you sent him money through PayPal which by their policy you should be able to get that back, I hope that it was the majority of the transaction. I would stop and do everything you can to get in front of this. I would give the guy one business day to get it paid off and provide you documentation from the bank. If not I would contact the bank, contact the title holder and file a report with the police. The longer you wait the more likely that the money might not appear in whole. If I was in your shoes I would drop what I was doing and drive to Houston to get this resolved. $30K ain't no joke, well at least to me, I would be personally escorting him to either the bank or police station. Again 20 days is too long and this guy has no excuse, get in front of it before it is too late.

At least you have the boat.

 

One question is if this is some kind of divorce issue. She owns the boat. He sells it and keeps the money. Saw it on divorce court last week:) The judge took it to him.

Lol good times! Yes I agree w the point you make. Hey your 20 minutes away! ;) you didn't have time for a pre sale inspection, how about a post sale? :D

 

Things tougher tomorrow if he does NOT have the note satisfied. Yes we have signed bill of sale and plenty of documentation in about 21 k ... The other was cash.

 

Fingers crossed... Well soon see. We surfed today w 1100 in the port locker and 350 on the seat. All I can say is wow ! Beauty, size and push is far beyond our 98 elite. Water was about 53 or so, a bit brisk for a shortie .. But I fraking surfed it like a kanuck in August!!!'

 

While the perfect pass display died, we were expecting it... no vibration on steering! Yay, 99% prop issue. Btw, the PO still worked! We knew what the menu options are w no display!

 

Love this boat.... If the bank calls for repo, I sold it for cash to some homeless guy! Lmao
